1. Introduction
Zunigas Construction 1 Corp (“we,” “our,” “us”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect personal data when you interact with us (e.g. via website, contact forms, texts, contracting). We also describe your rights under applicable law, including the New Jersey Data Privacy Act (“NJDPA”) effective January 15, 2025.
This Privacy Policy is part of the overall agreement you may have with us (including our Terms & Conditions).
2. Scope and Applicability
This policy applies to personal data of individuals (consumers) in New Jersey, and more broadly to data collected through our website www.zunigasco.com, contact forms, text/SMS, and client interactions.
Note: Under NJDPA, we may be required to comply if (a) we do business in New Jersey or target NJ residents, and (b) we process personal data of a threshold number of NJ individuals (e.g. 100,000 or “sale of data” with 25,000) Baker Donelson+1
Even if you are not a New Jersey resident, this policy may apply to how we handle your data via our operations targeting NJ or more generally.
3. What Data We Collect
Personal Data / Identifiers:
Name, email address, phone number
Project details (address, description, measurements, scope)
Payment / Financial Data:
Information required to facilitate ACH or Zelle transfers (bank account number, routing, possibly account holder name)
Note: We do not store full bank login credentials or sensitive account access tokens, unless explicitly consented and secured
Usage / Technical Data:
IP address, browser user agent, pages visited, referral URL, time stamps
Cookies, tracking pixels, log data
Tracking / Advertising Data:
We use Google Analytics and Meta (Facebook) Pixel or similar tracking tools to monitor website use, ad performance, and marketing attribution
Third-Party / Subcontractor Data:
When needed, we may share or receive data via subcontractors or service providers (vendors, suppliers, specialty contractors) under contract
Sensitive Data:

To the extent we process sensitive data, we will require opt-in consent and conduct additional assessments
4. How We Use Data (Purposes)
We use personal data for purposes including (but not limited to):
Responding to inquiries, estimating, project planning, contract performance
Processing payments, invoicing, billing
Sending project updates, reminders, scheduling via email, phone, or text
Marketing communications, promotional campaigns
Analytics, site improvements, ad tracking, attribution
Compliance with legal obligations (tax, regulatory, licenses)
We only collect data adequate and relevant for these purposes and will not keep extraneous information.
5. Your Rights Under NJDPA & Other Laws
If you are a New Jersey resident (consumer), you have rights including:
Access / Confirmation: Confirm whether we process your data and access a copy of it New Jersey Division of Consumer Affairs+1
Correction: Request correction of inaccurate data
Deletion: Request deletion (with some exceptions)
Data Portability: Request a portable copy in a commonly used format

Withdraw Consent: Where processing is based on consent, you may withdraw consent
You may appoint an authorized agent to make requests on your behalf
We will respond to requests within a reasonable timeframe (e.g. 30 days), free of charge (with limits on frequency).
6. Tracking, Cookies & Universal Opt-Out
We use cookies, tracking pixels, and similar technologies to collect usage and marketing data
We will support universal opt-out signals (e.g. Global Privacy Control) by July 15, 2025, in compliance with NJDPA’s universal opt-out requirement New Jersey Division of Consumer Affairs+1

7. Sharing Data with Third Parties & Subprocessors
We do not sell your personal data
We share data with subcontractors, vendors, analytics providers, marketing platforms — only under contractual agreements requiring confidentiality, limiting usage to purposes we approve, and requiring return or deletion after use
We require our processors to assist us in compliance with laws
8. Security Measures
We employ administrative, technical, and physical safeguards (encryption, access controls, logging, secure transmission)
We conduct periodic security reviews and audits
However, no system is 100% secure — we disclaim liability for residual risk
9. Retention & Deletion
We retain personal data only for as long as needed for our purposes (contract, legal obligations, analytics)
After that, we anonymize or securely delete data
When deletion is requested by you (and permissible), we will act promptly
10. Minors & Children
We do not knowingly collect data from children under 13
If we become aware of such data, we will delete it promptly
For users aged 13–16, NJDPA requires that if we know (or should know) their age, we must get consent before certain processing (like targeted ads) New Jersey Division of Consumer Affairs
11. Changes to This Policy
We may update this policy periodically. Material changes will be posted publicly with an effective date. We may notify you by email if feasible.
